India Implements Verification Mechanism to Ensure Legitimacy of RoDTEP Scheme Refunds and Compliance with International Trade Norms

In a bid to bolster transparency and compliance in its export incentive schemes, the Indian Government is implementing a verification system aimed at validating the reimbursement of input taxes under the Remission of Duties and Taxes on Exported Products (RoDTEP) scheme. This move comes in response to recent challenges faced by Indian exporters, including the imposition of anti-subsidy duties by the US and EU, due to a lack of clarity regarding the connection between RoDTEP benefits and input taxes.
The RoDTEP scheme, introduced in January 2021 as a replacement for the Merchandise Export from India Scheme (MEIS), aims to refund taxes paid on materials used in the production of exported goods. However, concerns have been raised regarding the inability of Indian exporters to effectively demonstrate this connection during inspections by international authorities.

To address these challenges, the government has established a verification process overseen by a team comprising officials from the Department of Revenue and the Directorate General of Foreign Trade. This team will conduct random checks on manufacturers to ensure proper documentation is in place to substantiate RoDTEP payments as legitimate tax refunds rather than subsidies.
The introduction of this verification system underscores India's commitment to aligning its export incentive schemes with international trade regulations, particularly those set forth by the World Trade Organisation (WTO). MEIS faced criticism from WTO member countries for its perceived lack of transparency and clarity in demonstrating the correlation between export incentives and input taxes paid by exporters.
By implementing a robust verification mechanism, India aims to instill confidence among international trading partners regarding the legitimacy and compliance of its export incentive schemes. This move not only safeguards Indian exporters from punitive measures such as anti-subsidy duties but also reinforces India's reputation as a responsible participant in the global trade arena.
Overall, the introduction of the verification system for RoDTEP scheme refunds marks a significant step towards enhancing transparency, accountability, and adherence to international trade norms in India's export promotion policies. Through effective implementation and monitoring, the government aims to ensure that export incentives are provided in a fair, equitable, and legally compliant manner, thereby facilitating sustainable growth and competitiveness in India's export sector.
