Top court tells housing ministry to reclaim Krishna Menon Marg residence after lapse of post-retirement grace period and special extension.

In an unprecedented move, the Supreme Court administration has asked the Ministry of Housing and Urban Affairs to immediately initiate the eviction of former Chief Justice of India, Dr. Justice DY Chandrachud, from his official residence on Krishna Menon Marg, citing overstaying beyond the permitted limit.
Justice Chandrachud, who retired in November 2024, has continued to occupy Bungalow No. 5, Krishna Menon Marg, well past the six-month grace period allowed under Rule 3B of the Supreme Court Judges Rules, 2022. According to officials, this grace period ended on May 10, 2025. A further special retention granted to him expired on May 31.

In a formal letter dated July 1, addressed to the housing ministry’s secretary, the Supreme Court administration emphasized the need for urgent repossession of the property, which is part of the apex court’s designated housing pool for serving judges.
"I am to request you to take possession of Bungalow No. 5, Krishna Menon Marg, from Hon'ble Dr. Justice DY Chandrachud without any further delay," the letter stated, underlining that all extensions had officially lapsed.
The court administration’s move is seen as a rare official communication highlighting concerns over the continued occupancy of official accommodations by retired dignitaries, especially in a high-demand zone like Lutyens’ Delhi. The housing ministry has not yet issued an official response.
