Apex Court emphasizes voters’ right to know political funding sources to ensure free, fair, and accountable elections
The Supreme Court of India has reiterated the importance of transparency in electoral funding, highlighting that voters have a fundamental right to know the sources of political party financing. The Court observed that transparency is essential to ensure free and fair elections and to uphold democratic accountability in the country.
The Court emphasized that access to information about political funding enables voters to make informed choices and strengthens public trust in the electoral process. It noted that undisclosed or opaque funding can undermine democratic principles by allowing undue influence and reducing accountability. Transparency in electoral finance helps prevent corruption and promotes fairness in political competition.

Referring to constitutional provisions, the Court linked electoral transparency to Article 19(1)(a), which guarantees the right to freedom of speech and expression. The Court has previously held that the right to information is an integral part of this freedom, enabling citizens to participate meaningfully in democratic governance. The judgment also highlighted that free and fair elections form part of the Basic Structure of the Constitution, which cannot be compromised.
The ruling reinforces the importance of electoral reforms aimed at improving disclosure requirements and ensuring accountability of political parties. It also strengthens the role of constitutional institutions in protecting democratic values and citizens’ rights.
This decision is significant in promoting transparent governance and empowering voters. By ensuring greater openness in political funding, the judgment contributes to strengthening India’s democratic framework and maintaining the integrity of its electoral system.
